TERMS OF SERVICE AND PRIVACY POLICY

Welcome to Coffee POS Free (hereinafter referred to as the "App"), developed by Kim Ngoc Tech Group (hereinafter referred to as the "Developer").

Please read these Terms of Service and Privacy Policy carefully before downloading, installing, or using the App. By downloading, installing, or continuing to use the App, you acknowledge that you have read, understood, and agreed to be bound by all the terms and conditions set forth below.

PART I: TERMS OF SERVICE
1. Nature of the Service (Local Environment Only)
The App is a utility tool designed to assist with the local management of expenses, revenues, inventory, and other operational data for coffee shops and restaurants.

Local Operation: The App operates entirely locally on your personal device. The Developer does not collect, store, or sync any of your business or financial data to any server owned or controlled by the Developer.

2. Data Ownership and Management
Sole Responsibility: You (the user) are the sole owner of and are fully responsible for all data entered into the App.

Risk of Data Loss: Because your data is stored directly on your device's local storage, it may be permanently lost under various circumstances, including but not limited to: device damage, device loss, factory resets, clearing app data via system settings, or uninstalling the App.

Backup Recommendation: You are solely responsible for proactively using any available backup or export features (such as exporting to Excel/CSV files) to secure your data. The Developer is under no obligation and has no technical means to recover any lost data for you.

3. Disclaimer of Warranties
Provided "As-Is": The App is provided on an "as-is" and "as-available" basis. The Developer makes no warranties of any kind, whether express or implied, regarding the absolute accuracy, completeness, uninterrupted operation, or error-free (bug-free) nature of the calculations, statistics, and reports generated by the App.

Verification Duty: All tables, charts, statistics, financial reports, and inventory calculations provided by the App are for visual reference and convenience only. You are solely responsible for checking, verifying, and reconciling all numbers before using them for official purposes, including but not limited to tax filing, legal financial reporting, or making critical business decisions.

Exclusion of Liability: To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, or consequential damages (including, without limitation, damages for loss of profits, business interruption, tax discrepancies, inventory loss, or loss of data) arising out of the use of or inability to use the App, even if the Developer has been advised of the possibility of such damages.

4. Limitation of Liability
Should any legal dispute arise and a competent authority rules that the Developer is at fault, you agree that the maximum aggregate liability of the Developer for any and all claims related to the App shall not exceed the actual amount you paid to purchase the App or any in-app features/services (if applicable).

PART II: PRIVACY POLICY
This Privacy Policy describes how we handle personal information and data when you use the App.

1. Data Collection
Since the App runs 100% offline/locally:

We DO NOT Collect: your personal information (such as name, phone number, email address), personal financial information, credit card details, or any of your business operational data (revenues, expenses, menu items, inventory).

Device Permissions: The App may request basic system permissions to function properly (e.g., read/write storage permissions to export Excel/CSV reports, or camera access to scan product barcodes). These permissions are processed strictly on your device, and no data is transmitted over the internet to the Developer or any third party.

2. Data Sharing and Disclosure
Because the Developer does not collect any of your data, we do not use, sell, share, or disclose any of your information to third parties.

3. Data Security
Your data is highly secure from external server-side cyber attacks because it remains entirely on your physical device. You are solely responsible for securing your own device to prevent unauthorized access to the data stored within the App.

PART III: GENERAL TERMS
1. Amendments to the Terms
The Developer reserves the right to modify these terms at any time to reflect updates to the App or changes in legal requirements. Any modifications will become effective immediately upon being posted in a new app update or on the official website. Your continued use of the App after such changes are posted constitutes your acceptance of the revised terms.

Chào mừng bạn đến với Coffee POS Free (sau đây gọi tắt là "Ứng dụng"), được phát triển bởi Kim Ngoc Tech Group (sau đây gọi tắt là "Nhà phát triển").

Vui lòng đọc kỹ bản Thỏa thuận này trước khi tải xuống, cài đặt hoặc sử dụng Ứng dụng. Việc bạn tiếp tục sử dụng Ứng dụng đồng nghĩa với việc bạn đã đọc, hiểu và đồng ý tuân thủ toàn bộ các điều khoản dưới đây.

PHẦN I: THỎA THUẬN SỬ DỤNG DỊCH VỤ (TERMS OF SERVICE)
1. Bản chất dịch vụ (Môi trường cục bộ - Local)
Ứng dụng là một công cụ tiện ích hỗ trợ quản lý chi phí, doanh thu, tồn kho và các thông tin vận hành nội bộ dành riêng cho quán cà phê và nhà hàng.

Môi trường hoạt động: Ứng dụng hoạt động hoàn toàn cục bộ (local) trên thiết bị cá nhân của bạn. Nhà phát triển không thu thập, không lưu trữ, không đồng bộ dữ liệu kinh doanh của bạn lên bất kỳ máy chủ (server) nào của Nhà phát triển.

2. Quyền sở hữu và Quản lý dữ liệu
Toàn quyền quản lý: Bạn (người dùng) là chủ sở hữu duy nhất và chịu trách nhiệm toàn bộ đối với mọi dữ liệu được nhập vào Ứng dụng.

Rủi ro mất dữ liệu: Vì dữ liệu được lưu trực tiếp trên bộ nhớ thiết bị của bạn, dữ liệu có thể bị mất vĩnh viễn trong các trường hợp bao gồm nhưng không giới hạn ở: thiết bị bị hỏng, bị mất, khôi phục cài đặt gốc (factory reset), xóa dữ liệu ứng dụng trong cài đặt máy, hoặc khi bạn gỡ cài đặt (uninstall) Ứng dụng.

Khuyến nghị sao lưu: Bạn có trách nhiệm chủ động sử dụng các tính năng sao lưu (nếu có) hoặc xuất dữ liệu (Export) ra các file độc lập để tự bảo quản dữ liệu của mình. Nhà phát triển không có khả năng và không có nghĩa vụ khôi phục dữ liệu đã mất của bạn.

3. Tuyên bố miễn trừ trách nhiệm pháp lý (Disclaimer)
Cung cấp "Nguyên trạng" (As-Is): Ứng dụng được cung cấp trên cơ sở "như hiện có" và "như sẵn có". Nhà phát triển không đưa ra bất kỳ bảo đảm nào, dù rõ ràng hay ngầm định, về tính chính xác tuyệt đối, sự không gián đoạn hoặc không có lỗi (bug) của hệ thống tính toán, thống kê báo cáo.

Trách nhiệm đối chiếu: Các bảng biểu, biểu đồ thống kê, báo cáo tài chính và tồn kho do ứng dụng kết xuất chỉ mang tính chất tham khảo trực quan. Bạn có trách nhiệm tự kiểm tra, đối chiếu và xác thực lại số liệu trước khi sử dụng cho các mục đích chính thức như: kê khai thuế, báo cáo tài chính pháp lý, hoặc đưa ra các quyết định kinh doanh.

Không chịu trách nhiệm thiệt hại: Trong mọi trường hợp, Nhà phát triển không chịu trách nhiệm đối với bất kỳ thiệt hại trực tiếp, gián tiếp, ngẫu nhiên hoặc mang tính hệ quả nào (bao gồm nhưng không giới hạn ở thiệt hại do mất mát lợi nhuận, gián đoạn kinh doanh, sai lệch số liệu thuế, thất thoát hàng hóa hoặc mất mát dữ liệu) phát sinh từ việc sử dụng hoặc không thể sử dụng Ứng dụng này.

4. Giới hạn trách nhiệm bồi thường (Limitation of Liability)
Nếu có bất kỳ tranh chấp pháp lý nào xảy ra và được cơ quan có thẩm quyền phán quyết rằng Nhà phát triển có lỗi, bạn đồng ý rằng mức bồi thường thiệt hại tối đa mà Nhà phát triển phải gánh chịu đối với toàn bộ các khiếu nại liên quan đến Ứng dụng sẽ không vượt quá số tiền thực tế bạn đã chi trả để mua Ứng dụng hoặc mua các gói dịch vụ mở rộng trong Ứng dụng (nếu có).

PHẦN II: CHÍNH SÁCH QUYỀN RIÊNG TƯ (PRIVACY POLICY)
Chính sách này mô tả cách chúng tôi xử lý thông tin cá nhân và dữ liệu của bạn khi bạn sử dụng Ứng dụng.

1. Thu thập dữ liệu
Vì ứng dụng hoạt động 100% offline/local:

Chúng tôi KHÔNG thu thập: thông tin cá nhân của bạn (tên, số điện thoại, email...), thông tin tài chính cá nhân, thông tin thẻ tín dụng hoặc bất kỳ dữ liệu kinh doanh nào của quán (doanh thu, chi phí, danh mục món ăn, tồn kho).

Quyền truy cập thiết bị (Permissions): Ứng dụng có thể yêu cầu một số quyền truy cập cơ bản trên thiết bị để phục vụ tính năng của ứng dụng (ví dụ: Quyền đọc/ghi bộ nhớ để xuất file Excel/CSV báo cáo, quyền camera để quét mã vạch sản phẩm). Chúng tôi chỉ sử dụng các quyền này tại chỗ và hoàn toàn không truyền tải bất kỳ dữ liệu nào ra bên ngoài thiết bị qua mạng Internet.

2. Sử dụng và Chia sẻ dữ liệu
Do Nhà phát triển không thu thập bất kỳ dữ liệu nào của bạn, chúng tôi không sử dụng, không bán, không chia sẻ và không tiết lộ bất kỳ thông tin nào của bạn cho bên thứ ba.

3. An toàn dữ liệu
Dữ liệu của bạn an toàn tuyệt đối khỏi các cuộc tấn công mạng nhắm vào máy chủ của bên thứ ba vì dữ liệu nằm hoàn toàn trên thiết bị của bạn. Bạn là người chịu trách nhiệm duy nhất trong việc bảo mật thiết bị cá nhân của mình để tránh người khác truy cập trái phép vào dữ liệu trên Ứng dụng.

PHẦN III: ĐIỀU KHOẢN CHUNG
1. Thay đổi Thỏa thuận
Nhà phát triển có quyền sửa đổi các điều khoản này bất kỳ lúc nào để phù hợp với các bản cập nhật của Ứng dụng hoặc thay đổi về mặt pháp lý. Các thay đổi sẽ có hiệu lực ngay khi được đăng tải trong bản cập nhật mới của Ứng dụng hoặc trên trang web chính thức. Việc bạn tiếp tục sử dụng ứng dụng sau khi có thay đổi đồng nghĩa với việc chấp nhận các điều khoản mới.
